Service fees and placement conditions

Standard service fee for all placements

Definitive Placement’s fee is based on 10% of 13 times monthly salary remuneration package offered to the candidate.

Car Sales Executive R7000 per placement, 5 % discount on 2nd placement

Our fee becomes immediately payable when a Definitive Placement recommended candidate, applicant or employee is employed and commences duty by the client.

If requested, the client will be obliged to furnish Definitive Placement with a copy of the employment contract in respect of the appointment Terms of payment strictly within 14 days of date of commencement in order for guarantee to be valid.

Employment of a Definitive Placement recommended candidate, applicant or employee would be deemed to be acceptance of our terms & conditions of business.

General conditions for all placements

Acceptance of a client’s job order and requirements by Definitive Placement are governed by the terms and conditions herein and employment of Definitive Placement recommended candidate, applicant or employee would be deemed to be acceptance of our terms and conditions of business.

When a candidate introduced and/or referred by Definitive Placement is appointed by a client (immediately or within a period of 12 (twelve) calendar months from date of introduction/referral, or is referred to another company or subsidiary/associated company), it will be considered as an acceptance of Definitive Placement’s terms and conditions. Definitive Placement client will be liable for the payment of the service fee as per the standard fee structure and the terms and conditions of business. This will also apply when a Definitive Placement candidate refers another candidate to the client.

Terms and conditions herein shall be deemed to be exclusive and applicable to each and every transaction/agreement/contract entered into between Definitive Placement and the client. Any variation thereof will only be binding if in writing and authorised and signed by Definitive Placement.

Definitive Placement reserves the right to charge interest at the rate of 2% per month on overdue accounts.

In the event that Definitive Placement instructs its attorneys to institute legal proceedings against a client, the client shall be liable for attorney’s legal fees on the scale as between attorney and client, collection commission, tracing fees and the like.

An introduction means the solicited or unsolicited introduction of the candidate, applicant or employee to the client by any of the following means

The receipt by the client of a resume or curriculum vitae by hand delivery, fax, email, registered mail and ordinary mail or by any other mean whatsoever from Definitive Placement.

Definitive Placement arraigning an interview between the client and the candidate

The telephonic referral of an applicant’s details by Definitive Placement to the client

Our candidates are all informed in advance of our CV submission to you, and explicitly nominate us to act on their behalf with you.

Guarantee

Definitive Placement offers a 90-day Replacement guarantee, subject to the guarantee being validated.

Definitive Placement offers a 30-day Replacement guarantee for Car Sales Executives, subject to the guarantee being validated.

The guarantee is validated by the full Service Fee paid within 14 days of the candidate commencing employment.

Terms of guarantee

In the event of termination of the candidate’s employment for any reason except redundancy, within the guarantee period and the guarantee being validated, Definitive Placement will endeavour to provide a replacement candidate within 3 months. There is a limit of one replacement per original vacancy specification. Should you decide not to replace the applicant, the guarantee is null and void. The aforementioned guarantee is granted for a maximum period of three months.

All requests for a replacement must be submitted in writing to Definitive Placement within 14 days of the candidate’s last date of employment.
Definitive Placement must be granted adequate time & opportunity to provide a replacement candidate (approximately two (2) weeks – negotiable).
If the replacement fee exceeds the original service fee, the client will be liable for the difference.
In the event of replacement candidates proving to be unsuitable for appointment, the client will qualify for a credit on their account with Definitive Placement. No cash refund will be made.

Indemnity Declaration

You hereby authorize Definitive Placement and its duly authorized verification agents to forward your fingerprints, and any other personal information, to verification information suppliers acting on behalf of Definitive Placement (including but not limited to the South African Police Services, the South African Criminal Record Centre, the Government of the RSA, and any relevant educational, training and credit organizations) for the purpose of verifying your personal credentials and records.

You furthermore authorize Definitive Placement ’s verification information suppliers to furnish information regarding your license, criminal, credit, professional and educational history to Definitive Placement .You furthermore unconditionally indemnify Definitive Placement and its verification information suppliers against any liability that may result from furnishing information in this regard

You understand that it is a condition of Definitive Placement verification information suppliers that this information is furnished by them solely for the purposes of your proposed/continuation of employment via the offices of Definitive Placement and that any information that is furnished to Definitive Placement may be disclosed to you before a decision is made on your employment or application for employment at Definitive Placement s sole discretion

You furthermore authorize Definitive Placement to supply any prospective employer with the details of any such verification information.

You accept and agree that these terms and conditions govern the relationship between you and Definitive Placement whether signed by you, or electronically accepted by you, or tacitly accepted by you through your action of attending an interview with a prospective employer which Definitive Placement introduced you to.

Terms and conditions of use

To the fullest extent permitted by law, Definitive Placement and its associates exclude all liability for any loss or damage (including indirect, special or consequential loss or damage) arising from the use of, or reliance on any services provided by Definitive Placement or its associates. Definitive Placement and its associates at all times limit their liability to the re-supply, where possible, of services not properly rendered; Definitive Placement will not be liable under this paragraph where the failure to render services properly is attributable partially or wholly to your actions or omissions.

You agree to keep Definitive Placement and its associates fully indemnified against any actual or contingent liabilities incurred in relation to any actions or claims brought by any person against Definitive Placement as a result of an actual or alleged breach by you of any law, or such other actions or claims brought in relation to the provision of services by Definitive Placement to you.
You indemnify Definitive Placement against all claims, actions, suits, liabilities, costs and expenses incurred on any account as a result of the listing or intended listing of any curriculum vitae or other personal information by you on www.definitiveplacements.co.za or any related website.

Definitive Placement will make every effort to ensure that your information is treated in the strictest confidence; however, you will not hold Definitive Placement responsible if your curriculum vitae was unlawfully copied from the Definitive Placement website through nefarious means and/or distributed without consent.

While Definitive Placement will implement precautionary measures to ensure that the Definitive Placement website is free from viruses, Definitive Placement cannot and does not guarantee or warrant that files available for downloading through the site or delivered via electronic mail through the site will be free of infection or viruses, worms, Trojan horses or other code that manifest contaminating or destructive properties. You are responsible for implementing sufficient protective software on your system that will satisfy your particular data security requirements and for maintaining a means external to your workstation for the reconstruction of any lost data.

You agree to take precautionary measures to ensure that your curriculum vitae loaded on the Definitive Placement website is free from viruses or other destructive code

Definitive Placement reserves the right to either reject or remove any curriculum vitae from its site(s) for any reason whatsoever.

You agree to present yourself truthfully in your curriculum vitas loaded on the Definitive Placement

Definitive Placement makes every effort to deliver applications for vacancies in the shortest possible time. You will however not hold Definitive Placement liable for any loss or damage as a result of any failure or delay in the delivery of an application for employment to a client or advertiser.

You agree, at all times, to deal with any information or products provided by  Definitive Placement a manner which abides by all applicable laws of South Africa, or of any other relevant jurisdiction (including, without limitation, privacy and copyright laws).

You may not assign or transfer your rights and obligations to any other person without Definitive Placements prior written approval (which will not be unreasonably withheld).
This agreement is governed by the laws of South Africa. You irrevocably and unconditionally submit to the exclusive jurisdiction of the Courts of South Africa, and waive any objection to legal action being brought in those Courts on the grounds of venue or inconvenient forum.

Definitive Placement retains all intellectual property rights contained in the data stored on Definitive Placement’s website, systems and services provided by Definitive Placement, and you not to infringe any of Definitive Placement’s rights without Definitive Placement’s prior written consent. This includes the use of public domain information represented on Definitive Placement’s website.
